Jim Moss, Kelsey Reckart, and Carmen Paige obtained Summary Judgment on behalf of Defendants in a lawsuit alleging claims related to surface water issues.
The Plaintiff sought substantial damages, alleging that the Defendants had altered the natural flow of surface water, resulting in increased runoff and damage to the Plaintiff’s property. Our litigation team conducted thorough party and expert depositions, ultimately presenting compelling evidence in support of summary judgment. Under applicable Alabama law, we demonstrated that the Plaintiff could not establish that the Defendants proximately caused the alleged increase in surface water onto the property. As a result, the Judge granted our motion for summary judgment dismissing all claims against our client.
