Friedman attorneys Tommy Dazzio and Ethan Wright recently obtained summary judgment on behalf of a charitable non-profit organization in an employment discrimination case. The plaintiff, a former employee, brought a lawsuit in state court alleging that the non-profit had wrongfully passed him over for a promotion.
Dazzio and Wright removed the action to federal court and moved for summary judgment on the grounds that the individual chosen for the promotion was better qualified for the position and the plaintiff lacked any evidence suggesting improper motives or discrimination. The Court agreed and dismissed all of the plaintiff’s claims against our client.
