Chris Zulanas and Dan Pickett secured a dismissal of an insurance carrier client in an attempted direct action against it arising out of a construction defect dispute. Homeowners made claims against their homebuilder and FDZ’s client, claiming the builder’s insurance carrier was estopped from paying a judgment against the builder because they were intended third-party beneficiaries of the builder’s insurance policy. The dismissal helped preserve Alabama’s law disfavoring direct actions by third parties against insurers.
