Friedman Attorneys Get Wantonness And Training Claims Dismissed Against Trucking Company And Its Driver Before Trial


Chris Zulanas and Jess Boone got three plaintiffs' wantonness and training claims dismissed against a trucking company and its driver in a personal injury lawsuit. The plaintiffs claimed that the truck driver drifted into their lane while traveling in a mini-van on the interstate and caused them to strike the truck at least twice. The injured driver and her passengers sued the truck driver and the trucking company accusing them of negligence, wanton conduct, and negligent or wanton training. The defendants filed a motion for summary judgment on the plaintiffs' wanton conduct and negligent or wanton training claims. The court found that the plaintiffs failed to establish that the trucker knowingly disregarded the safety of others when he changed lanes. Likewise, the court held that the plaintiffs failed to establish the truck driver was incompetent or that his employer should have known about his purported incompetence. Consequently, the court granted summary judgment in favor of the defendants. The case proceeded to trial on the plaintiffs' negligence claim.
